Trademark Infringement Victory in the Beauty and Events Industry

Our firm recently secured a significant win in a trademark infringement caseon behalf of a client in the beauty and events industry, specifically known for their work in wedding shows and related branding.

The case involved a third party’s unauthorized use of our client’s well-established and distinctive trademark, which had gained widespread recognition in the market. The infringing use created confusion among consumers and posed a serious threat to our client’s brand reputation and commercial interests.

Our team filed a trademark infringement suit before the High Court, asserting our client’s statutory and common law rights under the Trade Marks Actand intellectual property principles.

After a full hearing, the Court:

  • Entered judgment in favour of our client, and
  • Issued a permanent injunction restraining the third party from further use or exploitation of the infringing mark.

This judgment reinforces the protection accorded to registered trademarks and underscores the courts’ commitment to safeguarding brand identity in Kenya’s growing creative and lifestyle industries. We commend our team for their work in upholding our client’s rights and protecting the integrity of their brand.
